This Agreement applies when you (“Tester”) receive pre-release software (“Test Build”) from Vibrant Storms.
1. Confidentiality
The Test Build, documentation, and related information are confidential. You may not share screenshots, videos, or impressions without written permission.
2. Feedback Licence
You grant Vibrant Storms a worldwide, royalty-free, perpetual licence to use any feedback, bug reports, or suggestions you provide, without obligation to compensate you.
3. Limited Use Rights
We grant you a revocable, non-transferable, non-exclusive licence to install and use the Test Build solely for testing during the designated period.
4. No Compensation
Testing is voluntary and unpaid unless otherwise agreed in writing.
5. Termination
We may terminate access at any time. Upon termination you must delete all copies of the Test Build and related materials.
6. Disclaimer of Warranty
The Test Build is pre-release, may contain errors, and is provided “as is.” We disclaim all warranties, express or implied.
7. Limitation of Liability
To the fullest extent allowed by law, Vibrant Storms is not liable for any damages arising from or relating to the Test Build.
8. Governing Law
Dutch law governs this Agreement, with exclusive jurisdiction in the courts of Noord-Brabant.
